Description:
Smartphones, electronic health records, social media and other relatively new tools can make the practice of medicine easier, but can also introduce new sources of liability. Because new risk management issues are constantly emerging, even physicians with a generally solid understanding of medical practice liability stand to benefit from periodic updates on recent changes that might affect their decision-making processes or provide guidance on ways to better manage avoidable risks. This course is designed to address that need by focusing on recent legal and regulatory developments that have an impact on traditional thinking about liability and compliance concerns.

• Discuss how smartphones and other devices provide a trail of electronic evidence of your whereabouts and actions.
• Describe situations in which HIPAA allows for flexibility in following the Privacy Rule.
• Describe a physician’s duties when supervising mid-level practitioners.
• Explain how the “cut and paste” function of the EHR can endanger patient safety and lead to problems with Medicare.
• Understand the “do’s and don’ts” of professionally appropriate Internet use, particularly concerning social media.
• Discuss how using appropriate practice guidelines can reduce liability and the costs of care.
