Axel Schulz advises on a broad range of EC and German competition law matters. Mr. Schulz has recently been a part of a number of significant competition cases before the European Courts, including caseToshiba v. Commission – in which the General Court of the European Union annulled in full the fine imposed on Toshiba by the European Commission for its alleged participation in the Gas Insulated Switchgear cartel. He is also working on the Cathode Ray Tube appeal for Toshiba, as well as the oral hearings before the European Court of Justice, and the Transformers hearing before the General Court, as well as being involved in one of the Auto Parts investigations.

During his work on merger control under both EU and German law, he has dealt with collective dominance and countervailing buyer power, as well as structural links issues in industries including paper and pulp, aluminum, electricity generation and distribution, and pharmaceuticals. Recently, he advised Toshiba on its acquisition of tangible and intangible 3.5" hard disk drive ("HDD") assets, which involved a complex divestiture transaction and merger control submissions to multiple competition authorities. He has also provided merger control advice to Toyota Industries Corporation for its recent acquisition of a manufacturer of forks and other specialty attachments.

Mr. Schulz also has expertise in the pharmaceutical industry, advising on competition law issues in the fields of distribution, co-marketing, licensing and other kinds of vertical and horizontal cooperation agreements. He advised Almirall in their patent dispute with Boehringer Ingelheim, and Nycomed in the recent investigation by the Commission. He also secured favorable judgments for Abbott in two Greek court cases, and has represented GlaxoSmithKline in a number of cases before the European Courts in Luxembourg.
