Overview:
The objective of the FAD course is to clarify some profiles of medical responsibility for the health worker who works in the field of Addiction Services. The course is structured in different modules:

• The LEA and medical liability . What are the LEAs after the Prime Minister's Decree of 12 January 2017 and the purpose pursued by the legislator. The relationship between LEA and the constitutionally guaranteed right to health: the protection of the "irreducible core" of the right to health. The LEA and the interrelationships with the welfare system and cost containment. The LEA between right to health and financial needs. Health and social assistance to people with pathological addictions: the aim pursued, the concept of "harm reduction"; the Italian situation 3 years after the issue of the Prime Minister's Decree.
• Appropriateness of prescribing and lack of or delayed diagnosis in the screening process of addictive diseases and their comorbidities (psychopathologies, HCV, HIV, STD, etc.) . The Gelli Law, contractual and extra-contractual liability. The prescriptive appropriateness in court.
• The assignment of the drug . The 43 of the Consolidated Law 309/90, reads verbatim (paragraph 5) "The person to whom the medicines referred to in this paragraph are entrusted is required to exhibit the medical prescription or therapeutic plan in his possession upon request". It is essential to distinguish the various types of credit lines and to establish what are the behaviors that, in each case, must be held to avoid risks and errors.
• Responsibility of the physician with respect to the misuse and / or diversion of the drug. In order to correctly prescribe any therapy, the doctor should in fact formulate the diagnosis, define the objectives of the therapy and choose the drug after evaluating the risks and benefits; discuss them with the patient and acquire his cooperation; inform the patient of the precautions, side effects, storage rules in a way that is understandable to him; in the case of drug prescription, inform the patient of the legal risks of a use other than therapeutic use; document all this on the medical record.
• Sine die maintenance dose treatments and treatments for indications other than those approved in the SmPC of the drug. Off label use and consent.
• Minor and addictions. Access to health and social services and the capacity to act of the minor.
• The CME obligation for health professionals and its implications.
