Facilitated by Omar Ali BSc(Hons)Pharm DipClinPharm MRPharmS ACPP Pharmacy Consultant QIPP Adviser Payer Network & Former ERG Cost Modelling for NICE The aim of this 1-day masterclass is to empower nurses to think about how the law affects their practice with an emphasis on medicines and prescribing and how the current framework assesses clinical negligence within this arena.

The course will elaborate how the application of the law applies to nurses by interactive assessment of real cases where healthcare professionals have been sued. The day is run by a pharmacist and a legal expert, allowing a dovetail of medicines expertism alongside both legal framework and what happens in litigation.

The NHS Litigation Authority has stated that the cost of clinical negligence claims will rise to over £1.4 billion next year, reflecting a continued year on year rise in negligence cases and settlement amounts. This course aims to look at the drivers for rising negligence and the contribution of these cases from prescribing and medication errors. It has been reported that at least 1 in 20 primary care prescriptions feature medication errors including wrong dosage or strength, wrong medicine, wrong timings, dangerous interactions and contra-indications. Increasingly there are cases involving poor monitoring of medicines at which are high risk. This course will also explore processes of the law as applied by the Bolam test, along with examples of risk management with prescribing and practice. The continued increase in drug induced hospital admissions has highlighted never-events specified for certain drugs. This masterclass will also explore the human aspect to root cause analysis, why errors occure and what can be done to prevent them; we will compare and contrast learnings from the Swiss-Cheese-Principl’ and Airline CRM in which the airline industry has applied principles to make this the safest mode of transport.
